Description/History:
We Grandparents in the State of North Carolina are working with the General Assembly to get visitation laws established in the State of North Carolina, on a case by case basis.
We are on a mission to work with our Legislators in North Carolina to bring about this much needed change without effecting or challenging the "Rights of Parents...We are Parents ourselves, as well, as Grandparents, and we do not want to trade our Parental Rights for another right.
We do not want our own Parental Rights challenged in any way, shape or form.
After all, we are only asking for the right to petition the courts on a case by case basis to be able to visit with our precious beautiful Loving Caring Grandchildren.
It has now been brought to my attention in the last couple of weeks that yes indeed:
"Grandparent Visitation Laws are Constitutional". !!!
Grandparent visitation laws conditioned on visitation being in the child's best interest, are expressing a fundamental liberty interest of both grandparent and grandchild.
So...Let me ask you...Should a parent, only one in the chain of three generations, be given constitutional sanction to amputate the family unit from the child?
Fortunately the US Supreme Court has said with a resounding "NO" "Absolutely Not"! FYI-By holding that these cases must be decided on a "case by case basis", the majority of the Supreme Court held that the millions of grandparents and grandchildren who have now been reunited because of laws protecting their rights, will not be threatened with amputation by critics who have in the past claimed that these laws were "unconstitutional". However, media outlets have been a bit deceiving in their reporting tactics,concerning this issue, and they all need to be informed concerning the correct ruling from the U.S. Supreme Court, concerning this issue.
As of yet,"The State of North Carolina does not have "Grandparent Visitation Laws".??? So. Why is that? However, It is our mission as grandparents to change this... There are thousands of grandparents in the State of North Carolina who do not get to see their grandchildren...
According to information that I have just received, all fifty state laws which pertain to grandparent visitation, if it is in the best interest of the child, is suppose to still be intact???
It would be a significant disservice to the children of this country, who look at their families through their own eyes, to ignore their reality of what family truly is to them.
The true reality of the family unit has changed significantly in recent decades because the traditional nuclear family, as we once knew it, has now eroded. However, Grandparent Visitation Laws did not create that erosion. More varied and complicated family structures have arisen because of divorce, decisions not to marry, "un-wed parents", one night stands, single-parent families, remarriages, and step-families, and parents who abandon their children to temporary caretakers, so they can go party, and most of these caretakers are now the grandparents, because some of the parents have been deemed unfit.
However, no matter the circumstance, these grandchildren should not have to suffer the blunt of such erosion... These grandchildren should still be able to have a connection through bloodline and heritage to their own flesh and blood grandparents, for they are definitely family to those grandchildren... It is our mission to bring about restoration concerning these family relationships pertaining to the Whole family unit...
Every Grandchild should have the right to visit with their own Loving, Caring, Nurturing and "Responsible" grandparents. And all responsible Loving, Caring, Nurturing Grandparents should have the right to visit with their grandchildren. And the whole family unit should have the right to be in each others lives... There should no longer be any amputated or severed family's in North Carolina that has come about, as a result of there being no visitation laws in the State of NC...It is our mission to change this.
Every family member including Great grandparents, Grandparents, Uncles and Aunties, Cousins, and sisters and brothers should all have the right to visit with each other, as a family unit.
And, To all of you selfish,self-centered parents out there,who have so made the choice to hurt your own flesh and blood "Children" and "Parents",and who want to always be judging, and condemning, and who have chosen to play the role of God, let me just ask you one question...
Did you ever as a child, have to spend your holidays with one whole side of your family unit being missing, from your life, including the great-grandparents, Grandparents, Aunties and Uncles, Cousins and every single family member...from one side of your family?
And if you did, you should already know what that feels like...Right??? There have actually been some great-grandparents who on their death bed, have been denied the chance to even visit with their own flesh and blood grandchildren just one more time, before they died, as a result of some very selfish self-centered parents, who made the choice not to allow it, and by this State not having visitation laws...
And, Neither should Grandparents in North Carolina have to wait until their grandchildren are legally eighteen years of age, and or grown before being able to be in their lives. This is wrong. Something has got to be done concerning this issue...Changes just have to come forth! And one Word from God can turn this all around for the Good of this nation...
